Terms of Service

1. Agreement to Terms

By accessing or using WebAlza ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service. Your continued use of the Service constitutes acceptance of these Terms.

2. Description of Service

WebAlza is a multi-channel outreach and sales pipeline platform designed for web professionals. The Service provides:

  • AI website redesign generation
  • Multi-channel campaign automation across LinkedIn, Email, WhatsApp, Instagram, Messenger, Telegram, and Twitter/X
  • Unified inbox management
  • Lead pipeline CRM
  • PageSpeed and SEO audits
  • Automation workflows
  • Analytics and reporting

3. Account Registration

To use the Service, you agree that:

  • You must provide accurate and complete registration information
  • You are responsible for maintaining the security and confidentiality of your account
  • You must be at least 16 years old to use the Service
  • You will maintain only one account per person or entity and will not create additional accounts to circumvent plan limits

4. Subscription Plans and Billing

4.1 Plans

WebAlza offers the following subscription plans. Features and usage limits vary by plan:

  • Starter: $29 per month
  • Growth: $79 per month
  • Enterprise: Custom pricing — contact us for details

4.2 Billing

  • Annual billing is available and saves 20% compared to monthly billing
  • A 7-day free trial is available with no credit card required
  • Top-up credits are available for usage overages beyond your plan limits
  • All billing is processed via Polar and Creem, our payment providers

4.3 Renewal and Cancellation

  • Paid subscriptions automatically renew at the end of each billing period unless cancelled
  • Cancellation takes effect at the end of the current billing period
  • Prices may change with 30 days notice to subscribers

5. Acceptable Use

5.1 Permitted Use

  • You MAY use WebAlza for legitimate business outreach to prospects who have consented to receive communications or where permitted by applicable law
  • You MAY generate AI-powered website redesigns for sales and outreach purposes

5.2 Compliance Obligations

  • You MUST comply with all applicable laws and regulations, including the CAN-SPAM Act, the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), and the ePrivacy Directive
  • You MUST comply with LinkedIn's Terms of Service. WebAlza is not affiliated with LinkedIn

5.3 Prohibited Use

  • You MUST NOT send unsolicited spam or mass email to purchased lists without proper consent
  • You MUST NOT use the Service for harassment, discrimination, or any illegal activities
  • You MUST NOT attempt to reverse engineer, scrape, or otherwise compromise the Service or its underlying systems
  • You MUST NOT resell or sub-license the Service without prior authorization
  • You MUST NOT use the Service to send malware, phishing content, or fraudulent communications

Enforcement: Violation of these acceptable use terms may result in account suspension without refund.

6. LinkedIn Disclaimer

WebAlza is not affiliated with, endorsed by, or sponsored by LinkedIn. Users are solely responsible for ensuring that their use of LinkedIn through WebAlza complies with LinkedIn's Terms of Service, User Agreement, and all applicable laws.

WebAlza provides tools for LinkedIn automation but does not guarantee that LinkedIn will not restrict, suspend, or ban accounts that use automation. Users assume all risk associated with LinkedIn automation, including the risk of account restrictions or permanent suspension by LinkedIn.

7. AI Usage and Intellectual Property

  • Redesigns generated by the Service's AI tools are owned by the user who generated them
  • You are responsible for ensuring you have the legal right to use content sourced from third-party websites
  • AI providers (including OpenAI, Anthropic, Gemini, XAI, DeepSeek, and GLM) process your inputs through their APIs. Their respective terms of service apply to your use of their models
  • WebAlza does not claim ownership of user-generated content
  • You grant WebAlza a worldwide, non-exclusive license to process your content solely as necessary to provide the Service to you

8. Payment and Refunds

  • All payments are processed by Polar and Creem, our payment providers
  • A full refund is available within 7 days of your initial paid subscription, provided the Service has not been materially misused
  • After the 7-day window, cancellation takes effect at the end of the current billing period with no prorated refund
  • Top-up credits are non-refundable once they have been used
  • Initiating chargebacks or payment disputes without first contacting support may result in account suspension

9. Service Availability

  • The Service is provided on an "as-is" and "as-available" basis
  • We do not guarantee that the Service will be uninterrupted, error-free, or secure at all times
  • Scheduled maintenance, updates, and infrastructure changes may cause temporary downtime
  • The Enterprise plan includes a Service Level Agreement (SLA) guarantee. Contact us for specific SLA terms

10. Limitation of Liability

  • WebAlza shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service
  • Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim
  • We are not liable for LinkedIn account restrictions, suspensions, or bans resulting from your use of automation features
  • We are not liable for email deliverability issues caused by third-party email providers, spam filters, or recipient mail servers

11. Indemnification

You agree to indemnify and hold harmless WebAlza and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

  • Your misuse of the Service
  • Your violation of these Terms
  • Your violation of any rights of a third party

12. Termination

  • You may terminate your account at any time from your account settings
  • We may suspend or terminate accounts that violate these Terms or applicable law
  • Upon termination, your data will be deleted within 30 days
  • You may export your data before termination. We are not responsible for data that is not exported prior to account deletion

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated to subscribers via email. The updated Terms will be posted on this page with a revised "Last updated" date.

Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you may cancel your subscription and stop using the Service.

14. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration or, where arbitration is not permitted, in courts of competent jurisdiction.
